The company that feels infringed can take legal action supported by the principles of intellectual property rights. Company X has the rights to take legal action against company Y on the basis of fundamental principles under intellectual property rights. Company X is a manufacturer of cool soft for men under the trade mark as cool soft as the first company to register under such a distinctive name. Townsend was liable for passing off their goods as those of Warnink and the court applied the test for passing off which includes and any situation where misrepresentation is likely to injure the claimant’s goodwill. There was no trademark infringement but passing off. In order for one to claim passing off, there must be elements of the following aspects: There must be a goodwill or reputation attached to the goods or services of the claimant. In this case company X has marketed its product over a long period of time than company Y which has just started marketing same products. By marketing for a long period of time, company X has built a good relationship with customers. Sales have dropped due to company Y producing the same kind of product thus driving away customers to buy the other product and reducing the profitability of company X. This gives the right for company X to take legal action against company Y as this amounts to passing off. In the case of Buckley LJ H P Bulmer Limited vs Bollinger SA (1978), the court held that a man who engages in commercial activities may acquire a valuable reputation in respects of the goods in which he deals, or of the services which he performs or his business as an entity. The law regards such a reputation as an incorporeal piece of property, the integrity of which the owner is entitled to protect. So in this case, company X has built a reputation by marketing for a long period of time and by such the company’s image, property and reputation are entitled to be protected. For passing of to be established there must be an element of misrepresentation. This element of misrepresentation is shown by company Y when manufacturing the products with similar packaging in white, dark blue and green colors as the ones that company X has manufactured for a long period of time. Misrepresentation is a false description made consciously or unconsciously through the use of a mark, trade name or get-up (brand name, trade description, individual features of labelling or packaging) with which the goods of the claimant are associated and which is likely to mislead the sensible members of the public. 3.0 Misrepresentation In the case of Arsenal Football Club Plc vs Reed (2001), it was held that the disclaimer was sufficient enough to prevent misrepresentation which is a necessary ingredient for passing off. The customers had not been deceived into buying and there was no real likelihood of confusion. If the customer can see sufficiently clearly when he gets close to the station that the product sold is not that of Bp, he does not buy the petrol under the mistaken impression that he is getting Bp petrol. But in this case it is hard for a customer to clearly see the difference as the packaging of company X is white, dark blue and green, similarly to the one that company Y has started manufacturing. The packaging looks the same and this causes deception as company Y would be selling its product to customers who might buy on the essence that the product they are buying is for company X which has been manufacturing the product for a long period of time. By doing so company Y is deceiving customers into buying a product which is not the actual known product in the market which is manufactured by company X. This still amounts to passing off as company X is entitled to take legal actions under such circumstances. In the case of Combee international v Scholl (1975), the plaintiff manufactured insoles called odox heaters which contained activated charcoal. The defendant who was a well-known manufacturer of footwear also produced odox heaters. These were packaged in the same way. It was held that an injunction was granted on the basis that there was misrepresentation as the origin of the defendant’s product which was inferior. So in the same way company X can take legal actions against company Y because company Y is packing in the same way as the product of company Y is sold. Furthermore in the case of Wilkinson Sword Ltd vs Cripps Lee, the court held that the plaintiff had indeed have a reasonable cause of action. Meaning company X has the right to take legal actions. Damage to good wil Damage to good will would be a loss of reputation or control over reputation, exposure to litigation or erosion of the mark. Comparing the Text and the Two Filmed Versions of Jane Austen's Emma    After reading Jane Austen's Emma, then viewing the BBC production and Miramax films based on the novel one can understand why most authors are horrified over the translation of their novels into film.   The two film versions are quite different from one another, but both take such liberties with the original text as to wonder why the film makers of each even bothered with Austen's work.   The BBC production encompasses more of the tone and atmosphere of the text, the polite, mannered, upper-class social milieu of Victorian England than does the Miramax version, but both make interpretations of the text that belie the filmmakers' agenda than they do of Austen's own.   The films are different from the novel in many ways, including characterization, setting, action, dialogue and theme.   For example, the Miramax version of Emma with Gwyneth Paltrow portrays an Emma who is more like cupid armed with the bow of modern feminism.   In the BBC version, Emma is not portrayed as ligh tly and as humorous.   Instead, she is turned into a bantering harpy who lacks much of the charm of Austen's Emma.   This analysis will compare the first chapter of Emma with the corresponding opening scene in each film.   By doing so, we will see not only many differences among them (including some obtrusive additions on behalf of the films), but we will also see how the filmmakers differed in their interpretation of Austen's original. The opening scene of each film directly corresponds to the first chapter of Austen's novel.   In the text this chapter describes Emma Woodhouse as spoiled and self-willed, convinced she knows what is right for other people particularly when it comes to affairs... ...express all the ideology of modern day feminism.   Unfortunately, neither of these scenarios is faithful to the scenario of an unconventional Victorian woman as portrayed by a Victorian female author.   This is not to say that the filmed versions of Emma are not entertaining or without merit in their own right.   rather, it is to suggest that instead of faithfully recreating Austen's work, the filmmakers felt it necessary to add their own personal interpretations of the work, modern interpretations that serve to undermine Austen's text.   Like the tightly controlled, oppressive environment of Victorian England, Austen's Emma is best understood from within the confines the ideology of that elitist microcosm, not through the lens of modern interpreters who try to impose their own values on it. Mario Puzo, the author of many famous mafia books, such as the Godfather, writes the best-selling novel called, â€Å"The Last Don†. â€Å"The Last Don† is about a mafia don, Domenico Clericuizio, who was making arrangements, on the day his grandson and nephew were being christened, for his family to get out of the business and go straight. Don Clericuzio is the head of the most powerful crime family in America. He is a greatly feared man who has built a billion dollar empire, and believes that every debt must be paid and that family comes before anything.  Ã‚  Ã‚  Ã‚  Ã‚     Ã‚  Ã‚  Ã‚  Ã‚  The book, which has a very intresting plot, is a hard book to read. I liked this book for many reasons, but I also disliked it. Mario Puzo, trying to make the book as realistic as possible, had the speech in the book sound like a bunch of nonsense. The characters in the book, sounded very uneducated and it took some effort to think about what they meant and were trying to say. I guess it would be easier to watch the story on the television, but reading it is very confusing. I rarely ever read for pleasure, and I guess I picked the wrong book to try it out with. This book had me very frustrated with the language, and it took me a couple of times to get what was going on in the story.   Ã‚  Ã‚  Ã‚  Ã‚  One of the intresting things about the book, as well as most of the mafia-based stories is the way Puzo can take characters that are big in crime and violence and turn them into likeable characters. In this novel, the majority of the characters are likeable. Cross De Lena, the don’s great nephew, had feelings for Athena, the most beautiful and talented woman in Hollywood. His feelings grew so strong that Cross decides to make movies. This was one of the most surprising part of the novel because Cross’s desire to make movies causes him to take action without his family’s approval, which in return is a major problem that shocked the family.   Ã‚  Ã‚  Ã‚  Ã‚  This book is different then other books I have read because, usually I don’t get to pick out a book to read, it is usually assigned to me, so when I started to read a book that interests me, I thought I would be intrigued. But, actually the devil are lie to them, he just want them to help him to get the treasure and he does not have any reward to give back them. The four genies have a simple mind, so they do not think about the devil will lie to them, so they follow the devil to find the treasure and it take about 2 days to reach there. In the middle of the journey, Jinny, Winny and Tinny started to have conflict because they wanted to drink the magic water and do not want to let another to steal.Then, the devil started to smile because he has successful to provoke their relationship. Luckily, Niny, the leader of them which is lovely and kind, she started to tell them not to argue and try to persuade them but she failed because no one want to listen to her words. Few hours later, they reach the place, the devil is so exciting about the treasure that he have waited so long, so he call them to help him jump into the swamp to get it, but all of them are fighting because of the magic water. The devil can’t stand it, so he goes there and stop their fighting.When they all are pushing and pulling each other, the devil accidently felt into the swamp and he feel so painful because his weakness is cannot touch the swamp. The four genies quickly jump into it and try to save the devil, but it was too late, the devil has turn into ash. Unconsciously, Niny saw the treasure is floating on the swamp, so she take it and open it with the three other genies. After she opens it, they all smile to each other and hug each other because inside the treasure box, there was nothing inside. So, it means everything that they argue was a waste of time, and then they go back home and live happily just like before.
